Justices Uphold Abortion Procedure Ban

The Supreme court has upheld the Partial Birth Abortion Ban by a vote of 5-4. Common sense and basic human dignity has prevailed.

The Supreme Court’s new conservative majority gave anti-abortion forces a landmark victory Wednesday in a 5-4 decision that bans a controversial abortion procedure nationwide and sets the stage for further restrictions. It was a long-awaited and resounding win that abortion opponents had hoped to gain from a court pushed to the right by President Bush’s appointees. For the first time since the court established a woman’s right to an abortion in 1973, the justices said the Constitution permits a nationwide prohibition on a specific abortion method. The court’s liberal justices, in dissent, said the ruling chipped away at abortion rights.
The 5-4 decision written by Justice Anthony Kennedy said the Partial Birth Abortion Ban Act that Congress passed and Bush signed into law in 2003 does not violate a woman’s constitutional right to an abortion.Siding with Kennedy were Bush’s two appointees, Chief Justice John Roberts and Justice Samuel Alito, along with Justices Antonin Scalia and Clarence Thomas.
The law is constitutional despite not containing an exception that would allow the procedure if needed to preserve a woman’s health, Kennedy said. “The law need not give abortion doctors unfettered choice in the course of their medical practice,” he wrote in the majority opinion.
Doctors who violate the law could face up to two years in federal prison. The law has not taken effect, pending the outcome of the legal fight.
In dissent, Justice Ruth Bader Ginsburg said the ruling “cannot be understood as anything other than an effort to chip away at a right declared again and again by this court.”
Dr. LeRoy Carhart, the Bellevue, Neb., doctor who challenged the federal ban, said, “I am afraid the Supreme Court has just opened the door to an all-out assault on” the 1973 ruling in Roe. Wade.
The administration defended the law as drawing a bright line between abortion and infanticide. Reacting to the ruling, Bush said that it affirms the progress his administration has made to defend the “sanctity of life.”
“I am pleased that the Supreme Court has upheld a law that prohibits the abhorrent procedure of partial birth abortion,” he said. “Today’s decision affirms that the Constitution does not stand in the way of the people’s representatives enacting laws reflecting the compassion and humanity of America.”
It was the first time the court banned a specific procedure in a case over how—not whether—to perform an abortion.
Abortion rights groups as well as the leading association of obstetricians and gynecologists have said the procedure sometimes is the safest for a woman. They also said that such a ruling could threaten most abortions after 12 weeks of pregnancy, although Kennedy said alternate, more widely used procedures remain legal.
The outcome is likely to spur efforts at the state level to place more restrictions on abortions.
“I applaud the Court for its ruling today, and my hope is that it sets the stage for further progress in the fight to ensure our nation’s laws respect the sanctity of unborn human life,” said Rep. John Boehner of Ohio, Republican leader in the House of Representatives.
Jay Sekulow, a prominent abortion opponent who is chief counsel for the conservative American Center for Law and Justice, said, “This is the most monumental win on the abortion issue that we have ever had.”
Said Eve Gartner of the Planned Parenthood Federation of America: “This ruling flies in the face of 30 years of Supreme Court precedent and the best interest of women’s health and safety. … This ruling tells women that politicians, not doctors, will make their health care decisions for them.” She had argued that point before the justices.
More than 1 million abortions are performed in the United States each year, according to recent statistics. Nearly 90 percent of those occur in the first 12 weeks of pregnancy, and are not affected by Wednesday’s ruling. The Guttmacher Institute says 2,200 dilation and extraction procedures—the medical term most often used by doctors—were performed in 2000, the latest figures available.
Six federal courts have said the law that was in focus Wednesday is an impermissible restriction on a woman’s constitutional right to an abortion.
“Today’s decision is alarming,” Ginsburg wrote in dissent for the court’s liberal bloc. She said the ruling “refuses to take … seriously” previous Supreme Court decisions on abortion.
Ginsburg said the latest decision “tolerates, indeed applauds, federal intervention to ban nationwide a procedure found necessary and proper in certain cases by the American College of Obstetricians and Gynecologists.”
Ginsburg said that for the first time since the court established a woman’s right to an abortion in 1973, “the court blesses a prohibition with no exception safeguarding a woman’s health.”
She was joined by Justices Stephen Breyer, David Souter and John Paul Stevens.
The procedure at issue involves partially removing the fetus intact from a woman’s uterus, then crushing or cutting its skull to complete the abortion.
Abortion opponents say the law will not reduce the number of abortions performed because an alternate method—dismembering the fetus in the uterus—is available and, indeed, much more common.
This ruling did not ban these types of abortions.
Can you honestly look at this photo and say this is nothing more that a mass of cells?
This does not speak well of our society that we would rather murder our children so we can make our lives more convenient or allow us to pursue our career goals more easily.

I believe that this court ruling is an answer to the prayers of many people who believe that life begins at conception. No matter what one’s religious beliefs are, I believe that we can all agree that these babies have the God given right to live and should be protected. Some say that the most dangerous place in America is not the inner cities of our nation, but the inner sanctuary of the womb. If America and pregnant women who are about to undergo an abortion were shown the ultrasound pictures, or the post-abortion pictures, the number of abortions would decrease dramatically. So I applaud the high courts decision and President Bush’s courage in appointing justice Roberts and Alito to the bench. Our nation still has a long battle ahead to completely eliminate this heinous procedure but today was a great start.

hopefully this law gets hung up, just because one gets pregnant doesn’t mean she is ready to support this baby. Abortion is a much needed procedure in this day and age with 12 year olds getting pregnant. Not to mention, do away with abortion and all you have is young girls going into alleys with coat hangers and doing whatever it takes to get that baby out of them-usually at the cost of their own life. I’ll tie that 5-4 vote!

LoJac: do you not understand that with partial birth abortion, the baby is practically full-term and able to survive outside the womb? That the baby is partially outside the womb, but gets its brains sucked out before its head comes out: otherwise the doctor would be charged with murder…? There are other choices besides abortion if a woman doesn’t want/can’t afford to keep a baby: give the child up for adoption to a couple who cannot have children of their own but want to provide a loving home for an otherwise unwanted child. A woman I work with is in the process of adoption right now: she and her husband have a premature little boy born to a drug addict who likely won’t stay clean in order to get her baby back.

I heard some points that seem logical, like pregnant women getting back ally abortions hurting themselves to get the baby out. I believe to validate this atrocity with the premise to protect the one who is pregnant is not logical. Heroin is bad for you and extremely deadly, nevertheless people still buy it daily in “allies” but buying heroin and using heroin is illegal. I belive that having in abortion should be illegal and should be charged as a first through third digree murder. It is the same as killing a human being. IT IS A HUMAN BEING. I don’t agree with abortion after 8 weeks. A life is a life and I believe that all girls should be fitted with a coil from when they start their periods until they are in a stable relationship and have a good job in order to support the baby and that all couples trying for kids should have to attend a mandatory course to assess whether they are physically and mentally capable of raising a child.
This way abortion would become obsolete and the poor little lives of these babies can be saved as this way they will not be unwanted.

I am a proud mother of two. i already don’t approve of abortion as a way out of your responsibilities, but I do not believe anyone accept god himself, or what ever god/creator you may believe in, has the right to take you off this world. I do, however, stand by having the choice of abortion for women and young girls who were rape victims and victims of similar crimes. I am currently leading an online blog/protest against Obama for president because of his malice ideals and immoralities. I cannot understand how a man who has children could absolutely stand by this idea 100%. In my honest opinion this canidate has no reason being in office and I would much rather NOT vote at all than try and make a decision between two such unimpressive, undissicive and unqualified men. I really wanted to vote for Hilary Clinton, but se is no longer partisipating in this campain for presidencey.

This is murder! what difference does it mean. what? because the infant is still inside the mother. ohh!! thats right aparently its not an infant inside the mother, its an embrio. So because its known as an embrio its not known as a child or baby. so does that make it ok to end its life… Of course not Damnit! I feel that after a certain number of weeks, a woman should not be allow to have an abortion. She should have enough time to consider all her options and determine the best decision.
I would also like to state that a number of children born into poverty are offsprings of teenage parents. Not that it’s an excuse, but it is a valid point.

I just can’t believe how people think that an unborn child is just cells. Look at those pictures and you can see that this is a baby that was killed. Yeah, it’s awful if someone gets pregnant by rape or just can’t afford the baby, but killing it is just so horrible. If someone delivers a baby and kills it, she would be sent to jail for murder. 88% of abortions take place within the first 12 weeks, before the “quickening” which would trigger the motherly instinct to recognize the fetus. So actually there is no difference between how the pregnant woman feels about the pregnancy and her monthly mentruation flow (maybe anxiety if it is not planned) before the 16th week or so. Should you also treasure the menstruation blood cells? It contains an ovum which is potential life, too?
Let the woman decide what to do. Do not try to decide for her. It is after all her body, not yours. If you are raped and want to carry the pregnancy for adoption, that’s your private business, nobody should or would or could say anything to you about the decision, either.

No one should tell you or demand you to report to authority about your own body. A woman’s body is not a “state property”.

Abortion and murder are two different things – from a societal perspective. Murder is illegal due to its disruptive effect on society. You cannot have a stable society with people killing each other. In some cases – where the societal interest is better served by eliminating a certain person – then murder is actually supported in law. Thus the death penalty for certain crimes. Murder is also condoned in armed conflict.
Abortion does not fit into the same class as murder because it does not have the same kind of impact on the stability and security of the society. Whatever the scientific and moral considerations – is an unborn child a person, do woman have the final say in their reproductive process – having an abortion does not have the same impact, on the society as a whole, as killing post birth.
This places abortion in a gray area – it comes down to what you believe. Just because you believe something does not make it right. Nor should you be allowed to impose your beliefs on me. If you do not want an abortion then do not have one. Espouse your views and convince others not to have an abortion. However, you do not have the right to force me to act in a certain way just because you believe that it is wrong.

Trust women. They are able to make decisions about their own life/body.
As a matter of fact, abortion rate is declining as a result of the efforts made by organizations such as Planned Parenthood. Women are increasingly using effective ways of contraception, therefore there are fewer and few cases of abortion. However, Roe v Wade is there to ensure women’s right to privacy, to ensure that women can make their decisions.
All in all, viewing abortion as murder is up to you. If you hold such deep hatred against women, go ahead. If this thought of yours that all pro-choicers should go to hell delights you somehow, go ahead. Entertain yourself with your mysogynous hatred. You have that freedom to have your own thoughts, too.

Abortion should be legal until after the 8th week…you can post all the pictures of dead fetuses you want…still doesn’t take away from the fact that people have the right to choose. And a fetus does not have that right, not until it has reached the age of accountability. Give your opinions yes, but leave judgements to God. What do you think about a mother on welfare with six kids? The only she knows how to get the money she needs, is to sleep with a man for a little bit of money, because the father is MIA. The one thing that I most definately do not agree on is when mothers say. Its my body not state property. Well thats the fetus’ body not yours Thats someone elses life not yours. Just looking at this pictures bring tears to my eyes..And I look at my daughter and could not imagine even doing that while I was pregnant with her…there is just to much joy that these women are missing out on…and I pray to God that they don’t have children in the future. Just because of what they had done…but how could the doctors who do this live with themselves by being apart of the killing? Don’t they have children? I had my little girl when I was 18 and to me there is no such thing as not being ready..they will make you ready…and children don’t stop your future only you can stop your future…And it makes me so angry just to know that there women out here who wants children and can’t have any but the ones who can kill theirs..i just don’t understand. They are the best gift that God could ever give to a woman. Well, I must say that I am shocked by these pictures. I only just learned about partial-birth abortion about 5 or so years ago, when the Kerry/Edwards campagne fought to put the bill through congress. Thank GOD for Bush’s decision to veto the bill. Forget Iraq, forget judging him because he had to finish his “daddy’s work,” Bush is a Bible believing Christian. Indeed we were blessed to have his cabinet go up to bat for these babies. What I don’t get….it’s always about the 9th ammendment and the woman’s right to choose, but I ask you this, what about that babies right to live??? Doesn’t a woman care enough about an unborn life inside her to never let this violent murder on a baby occur? Sadly, I know the answer is no. Well God be with all of you who must make such a decision. I myself, use to be pro-choice, but God has completely changed my mind on the issue. Abortion is an unnecessary procedure! A child has a right to live; regardless of how they were conceived! So what if you got pregnant on “accident” or if you were raped; the rape is a tragic event; but don’t blame an innocent child for what happened to you. Children are precious; and unborn babies are precious little souls waiting to be born. If you have an abortion you might be killing the next president or the next greatest rocket scientist; are you really going to be able to live with yourself for killing your child?
