President and his powers of the United States

Amendment 1 – Freedom of Religion, Press, Expression

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

I put this here first to remind the ability and right of me as a citizen of the United States, that I have the right to express my right of Speech and Expression.  I further state that as a citizen of the United States I have certain concerns that are gravely at issue within our borders that are in dire straights of being unconstitutional and unlawful.  I mention a few as I explain some of my thoughts here and am curious as to whether what has been going on in the last several months of the new president are actually his duties or not.   Upon researching what his duties are I find that several of the duties he has taken on has not been the definition of the President and has not been approved to the extent in which they have advanced to.  As a result it appears that many boundries of his duties have been overextended and have not been checked by the United States Checks and Balance system and also has not ceased or stated to be ceased by the Congress of the United States. 

I have been wondering exactly what the President’s powers were.  As I have lived my life I have seen many Presidents who were in charge of the United States, and have never seen some of the antics of this current sitting President doing the things he is doing and no one is saying anything about it.  So I thought I would look it up in the Constitution, the Declaration of Independence and the Bill of Rights.  The government possesses or should possess a balance of power.  A checks and balance was placed by the founders of our country to eliminate too much power over the people who can or will corrupt the United States, who will change the concept of a republic of states which maintains our freedom, liberty and pursuit of happiness.  In so doing in this current administration, all of these rights have been trampled on to the point that no division appears to be following their duties as officers and elected officials in their capacity in the United States. 

The balance of power consists of the three branches of government  consists of the legislative branch which makes laws, the judicial branch who interprets the laws, and the executive branch who administers the law. 

I strongly believe the balance of power is so far off balance at this current date that it makes one think, how can all this be going on?  It is because that the President, Senate and House of Representatives are all in a party called Democrats?  I find it odd that even with the all 3 houses of President, Senate and House of Representatives are all agreeing and not one of the houses are consenting or disagreeing on matters of the United States.  It bothers me that there is no checks and balance to establish limits and boundries of the duties of the President or any other branch of government. 

I listed the duties and find too, that the President can also appoint cabinet members including Czars which are covered in the Constitution with the consent of the Senate and any new positions are made by lawCzars have not been made by law to be any Secretary of any division in the government and therefore unconstitutional. 

I do not see in the constitution the duties of the President to be taking over business and favoring one group over another of who gets what in a new company.  This is NOT in his duties as President.  There is only one potential bill that is requiring the President to share information and papers of the Chrysler deal.  Congress is NOT doing their job to protect and secure the United States and the people within.  There is no dissent or discussion, there is no permission or agreement to enter into any agreement with the House or Senate.  I do not see anything that shows that the Senate agreed to anything.  This therefore is unconstitutional.  I also see another area of favoritism that relates to taking favor over one group of people over another which is never allowed through various civil liberties and rights.  This again is unlawful and unconstitutional.

The duties of the President does not call for the President to travel all over the world and apologize for the previous administration or the United States for prior talks, agreements, disagreements, trade or any other issue.  I also know as well as every American that the President is to bow before no foreign leader as this is not in the best interest of the United States because it appears we are weak and below them in stature.  The United States is the supreme law in the nation and in the world.  We bow to no one.  Our military has protected the United States and fought many wars as a result of the inferior belief by others that we are weak.  We are not to ever give the impression that we are.  This is the sign of a traitor and should be watched carefully of the treaties and agreements that he enters into because he is suspect of not looking out for the best interest of the United States.  His duties are to preserve, protect and defend the Constitution of the United States which he took an oath before entering the office of the Presdient on his first day which in his case took the oath twice because he made a mistake the first time, those acts above by this sitting president Barack Obama, were not in the best interest of the United State to Preserve, Protect and Defend the Constitution and therefore is unconstitutional. 

Are there any others that should be listed?

Before he enters on the Execution of his Office, he shall take the following Oath or Affirmation:–”I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.”

The President has several constitutional duties aside from the general “enforce the laws” duty. These are:

  • To be Commander in Chief of the military
  • To conduct foreign affairs
  • To negotiate treaties with other nations
  • To nominate members of the cabinet, judiciary, etc.
  • To review and sign or veto bills
  • To administer the laws of the nation
  • To issue pardons as he sees fit
  • To address the Congress from time to time to assess the state of the nation

The President, as leader of the nation, and as leader of his or her party, de facto if not de jure, has several other roles. These are:

  • Morale builder
  • Party Leader
  • Legislative leader
  • Coalition builder
  • Crisis manager
  • Personnel recruiter
  • World Leader
  • Budget Setter
  • Priority setter
  • Bargainer and Persuader
  • Conflict resolver

Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Under the system of checks and balances, each branch acts as a restraint on the powers of the other two. The president can either sign the legislation of Congress, making it law, or Veto it. The Congress, through the Senate, has the power of advise and consent on presidential appointments and can therefore reject an appointee. The courts, given the sole power to interpret the Constitution and the laws, can uphold or overturn acts of the legislature or rule on actions by the president. Most judges are appointed, and therefore Congress and the president can affect the judiciary. Thus at no time does all authority rest with a single branch of government. Instead, power is measured, apportioned, and restrained among the three government branches. The states also follow the three-part model of government, through state governors, state legislatures, and the state court systems.
